The Youth IT Shadow Program ("Program") is a voluntary, unpaid learning experience operated by Gavi Hand Enterprise, Inc. ("GHE"). The Program provides students with the opportunity to observe and assist with IT-related activities at vetted partner business locations and community events, under supervision.
Participation in the Program is strictly voluntary and unpaid. Students are not employees, contractors, or agents of GHE or any partner business. No compensation, benefits, or employment relationship is created by participation. Students are not entitled to wages, workers' compensation, or unemployment benefits.
A parent or legal guardian must accompany the student and remain physically present at all times during on-site visits to partner business locations. GHE does not assume custodial responsibility for any student at any time. The parent/guardian is solely responsible for the student's safety and behavior during all program activities.
Students and accompanying parents agree to:
During Program activities, students may be exposed to confidential business information, client data, or proprietary systems. Students and parents agree to maintain strict confidentiality regarding all such information encountered during the Program. This obligation survives termination of participation.
The parent/guardian acknowledges that participation in the Program involves certain inherent risks, including but not limited to: exposure to electronic equipment, travel to and from partner locations, and interaction with business environments. The parent/guardian voluntarily assumes all such risks on behalf of themselves and the student.
To the maximum extent permitted by law, the parent/guardian, on behalf of themselves, the student, and their heirs, executors, and assigns, hereby releases, waives, and discharges Gavi Hand Enterprise, Inc., its officers, directors, employees, volunteers, agents, and partner businesses from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of participation in the Program, except in cases of gross negligence or willful misconduct by GHE.
The parent/guardian agrees to indemnify, defend, and hold harmless GHE and its partner businesses from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from the student's actions or the parent's/guardian's failure to supervise the student during Program activities.
If the optional photo/media consent is granted on the application form, the parent/guardian grants GHE permission to use photographs, video, and other media captured during Program activities for educational, promotional, and fundraising purposes. This consent may be withdrawn at any time by written notice to GHE.
GHE reserves the right to terminate any student's participation at any time for any reason, including but not limited to violations of the Code of Conduct. Either party may discontinue participation with written notice. No refunds or compensation apply, as the Program is free and unpaid.
GHE makes no guarantees regarding employment, internship placement, academic credit, or any specific outcome as a result of participation in the Program. The Program is intended solely as a learning and exposure opportunity.
This Agreement shall be governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved through good-faith negotiation, and if necessary, binding arbitration in Plymouth County, MA.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
