1. Acceptance of Terms
By accessing or using the GrowLocal Farm Directory application and website (the "Service"), operated by Gavi Hand Enterprise, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
GrowLocal is a free farm directory that connects consumers with local farms and farmers markets across the United States. The Service allows farmers to register their listings, consumers to search for farms by location and product, and community members to vouch for the authenticity of listings.
3. User Accounts and Registration
Farm owners may register their farms through our registration form. By registering, you represent that:
- You are the owner or authorized representative of the farm you are registering
- The information you provide is accurate, current, and complete
- You will update your listing if your information changes
- You are at least 18 years of age
4. Farm Listings
Registered Listings: Farms registered directly by their owners are marked as "Owner Verified." You retain control of your listing and may request updates or removal at any time by contacting us.
Imported Listings: Some listings are imported from public government databases (such as the USDA Farmers Market Directory) and are marked as "Unverified." These listings contain only publicly available information. Farm owners may claim and verify these listings at any time.
Community Verification: Users may vouch for farms they have personally visited or purchased from. Three community vouches upgrade a listing to "Community Verified." This is a community-driven trust signal, not a guarantee or endorsement by Gavi Hand Enterprise, Inc.
5. Acceptable Use
You agree not to:
- Register a farm you do not own or represent
- Provide false or misleading information in a listing or vouch
- Use the Service for any unlawful purpose
- Attempt to access, tamper with, or disrupt the Service's servers or databases
- Scrape, harvest, or bulk-download data from the Service for commercial purposes
- Submit fraudulent vouches or manipulate the verification system
- Use the Service to send spam, solicitations, or unwanted communications to listed farms
We reserve the right to remove any listing, vouch, or user content that violates these terms, at our sole discretion.
6. Intellectual Property
The GrowLocal name, logo, design, and software are the property of Gavi Hand Enterprise, Inc. User-submitted content (farm descriptions, contact information) remains the property of the submitting user, with a license granted to us to display it within the Service.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Farm listings are accurate, complete, or current — listings are provided by farm owners and public databases, and we do not independently verify every detail
- Any farm listed in the directory meets specific quality, safety, or regulatory standards
- Products purchased from listed farms will meet your expectations
GrowLocal is a directory, not a marketplace. We do not facilitate transactions, process payments, or guarantee any products or services offered by listed farms. Any transaction between you and a farm is solely between you and that farm.
8. Limitation of Liability
To the fullest extent permitted by law, Gavi Hand Enterprise, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid to use the Service (which is zero, as GrowLocal is free).
9. Indemnification
You agree to indemnify and hold harmless Gavi Hand Enterprise, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Removal and Termination
We may remove any listing or terminate any user's access to the Service at any time, for any reason, without notice. Reasons for removal may include violation of these Terms, fraudulent activity, or inactivity.
Farm owners may request removal of their listing at any time by emailing [email protected].
11. Third-Party Services
The Service uses third-party providers including Mapbox (maps), Cloudflare (security), and Zoho (email). Your use of the Service is also subject to the terms and policies of these providers.
The Service may contain links to third-party websites (such as farm websites). We are not responsible for the content, accuracy, or practices of any third-party sites.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
